{"id":3621,"date":"2019-03-12T20:40:55","date_gmt":"2019-03-12T20:40:55","guid":{"rendered":"https:\/\/avantges.com\/?p=3621"},"modified":"2024-10-17T13:11:37","modified_gmt":"2024-10-17T11:11:37","slug":"registro-de-jornada-a-tiempo-completo","status":"publish","type":"post","link":"https:\/\/avantges.com\/es\/registro-de-jornada-a-tiempo-completo\/","title":{"rendered":"Registro de Jornada a Tiempo Completo"},"content":{"rendered":"<p><span lang=\"ES-TRAD\" style=\"margin: 0px; font-family: 'Calibri',sans-serif;\"><span style=\"color: #000000;\">12\/03\/2019.- Hoy, d\u00eda 12 de marzo, se ha publicado en el BOE el <a href=\"http:\/\/bit.ly\/2tZmAhG\">Real Decreto-ley 8\/2019, de 8 de marzo<\/a>, que incluye, entre sus medidas, el registro de jornada diario obligatorio.<\/span><\/span><!--more--><\/p>\n<p><span lang=\"ES-TRAD\" style=\"margin: 0px; font-family: 'Calibri',sans-serif;\"><span style=\"color: #000000;\">Hasta ahora s\u00f3lo era obligatorio el registro de la jornada de los trabajadores a tiempo parcial. No obstante, la modificaci\u00f3n de los arts. 4, 12, 34 y 35 del Estatuto de los Trabajadores, mediante el citado Real Decreto-ley, impone a las empresas la obligaci\u00f3n de implantar un sistema de registro de la jornada laboral efectiva de <b>los trabajadores a tiempo completo<\/b> que no se hayan comprometido de forma expresa, individual o colectivamente, a realizar horas extraordinarias y, de esta forma, controlar las horas extra no pagadas o fraudulentas.<\/span><\/span><\/p>\n<h3><span lang=\"ES-TRAD\" style=\"margin: 0px; font-family: 'Calibri',sans-serif;\"><span style=\"color: #000000;\">\u00a0<\/span><\/span><span lang=\"ES-TRAD\" style=\"margin: 0px; font-family: 'Calibri',sans-serif;\"><span style=\"color: #000000;\">Principales aspectos del Registro de Jornada a tener en cuenta:<\/span><\/span><span lang=\"ES-TRAD\" style=\"margin: 0px; font-family: 'Calibri',sans-serif;\"><span style=\"color: #000000;\">\u00a0<\/span><\/span><\/h3>\n<ul type=\"disc\">\n<li style=\"margin: 0px; text-align: justify; color: #000000; font-family: 'Calibri',sans-serif; font-size: 12pt; font-style: normal; font-weight: 400;\"><span style=\"margin: 0px; font-family: 'Calibri',sans-serif;\">En primer lugar, la empresa garantizar\u00e1 el registro de jornada diario. Dicho registro deber\u00e1 incluir el <u>horario concreto de inicio y finalizaci\u00f3n<\/u> de la jornada de trabajo de cada persona trabajadora, sin perjuicio de la flexibilidad horaria.<\/span><span style=\"margin: 0px; font-family: 'Calibri',sans-serif;\"><span style=\"color: #000000;\">\u00a0<\/span><\/span><\/li>\n<\/ul>\n<ul type=\"disc\">\n<li style=\"margin: 0px; text-align: justify; color: #000000; font-family: 'Calibri',sans-serif; font-size: 12pt; font-style: normal; font-weight: 400;\"><span style=\"margin: 0px; font-family: 'Calibri',sans-serif;\">Mediante negociaci\u00f3n colectiva o acuerdo de empresa o, en su defecto, decisi\u00f3n del empresario previa consulta con los representantes legales de los trabajadores en la empresa, se organizar\u00e1 y documentar\u00e1 este registro de jornada.<\/span><span style=\"margin: 0px; font-family: 'Calibri',sans-serif;\"> <span lang=\"ES-TRAD\">Salvo la modificaci\u00f3n de la norma, podr\u00e1 realizarse el registro de la jornada mediante sistemas manuales, an\u00e1logos o digitales.<\/span><\/span><span style=\"margin: 0px; font-family: 'Calibri',sans-serif;\"><span style=\"color: #000000;\">\u00a0<\/span><\/span><\/li>\n<\/ul>\n<ul type=\"disc\">\n<li style=\"margin: 0px; text-align: justify; color: #000000; font-family: 'Calibri',sans-serif; font-size: 12pt; font-style: normal; font-weight: 400;\"><span lang=\"ES-TRAD\" style=\"margin: 0px; font-family: 'Calibri',sans-serif;\">Adem\u00e1s, los registros de la jornada deber\u00e1n <u>conservarse durante cuatro a\u00f1os.<\/u> Permanecer\u00e1n a disposici\u00f3n de los trabajadores y de representantes de los trabajadores. Tambi\u00e9n de la Inspecci\u00f3n de Trabajo y Seguridad Social.<\/span><span style=\"margin: 0px; font-family: 'Calibri',sans-serif;\"><span style=\"color: #000000;\">\u00a0<\/span><\/span><\/li>\n<\/ul>\n<ul type=\"disc\">\n<li style=\"margin: 0px; text-align: justify; color: #000000; font-family: 'Calibri',sans-serif; font-size: 12pt; font-style: normal; font-weight: 400;\"><span lang=\"ES-TRAD\" style=\"margin: 0px; font-family: 'Calibri',sans-serif;\">El incumplimiento de esta obligaci\u00f3n se considerar\u00e1 infracci\u00f3n grave. En consecuencia, ser\u00e1 sancionable con una <u>multa m\u00e1xima de 6.250 euros<\/u>.<\/span><\/li>\n<\/ul>\n<p><span lang=\"ES-TRAD\" style=\"margin: 0px; font-family: 'Calibri',sans-serif;\"><span style=\"color: #000000;\">Finalmente, l<\/span><\/span><span lang=\"ES-TRAD\" style=\"margin: 0px; font-family: 'Calibri',sans-serif;\"><span style=\"color: #000000;\">as empresas disponen, desde hoy, de dos meses para aplicar esta medida.<\/span><\/span><\/p>\n<p><span lang=\"ES-TRAD\" style=\"margin: 0px; font-family: 'Calibri',sans-serif;\"><span style=\"color: #000000;\">Para cualquier informaci\u00f3n adicional sobre el registro de jornada, no dude en contactarnos.
