{"id":3694,"date":"2021-06-29T14:37:49","date_gmt":"2021-06-29T14:37:49","guid":{"rendered":"https:\/\/avantges.com\/?p=3694"},"modified":"2024-10-17T13:11:36","modified_gmt":"2024-10-17T11:11:36","slug":"registro-retributivo-y-protocolo-anti-acoso","status":"publish","type":"post","link":"https:\/\/avantges.com\/es\/registro-retributivo-y-protocolo-anti-acoso\/","title":{"rendered":"Obligaciones en materia de Igualdad: Registro Retributivo y Protocolo Anti-Acoso"},"content":{"rendered":"<p><em>29\/06\/2021.- \u00bfSab\u00edas que todas las empresas, independientemente del n\u00famero de personas que tengan en plantilla, est\u00e1n obligadas a mantener un registro retributivo y un protocolo anti-acoso?<\/em><\/p>\n<p>REGISTRO RETRIBUTIVO<\/p>\n<p>El art\u00edculo 28.2 del Estatuto de los Trabajadores establece <strong>la obligaci\u00f3n para todas las empresas de tener un registro retributivo<\/strong> de toda su plantilla, incluido el personal directivo y los altos cargos.<\/p>\n<p>Este registro debe reflejar los <strong>valores medios<\/strong> de:<\/p>\n<ul>\n<li>Salario fijo.<\/li>\n<li>Complementos salariales.<\/li>\n<li>Percepciones extra-salariales.<\/li>\n<li>Horas extraordinarias.<\/li>\n<\/ul>\n<p>Todos los valores se mostrar\u00e1n <strong>desagregados por sexo y distribuidos por puestos de trabajo de igual valor<\/strong>.<\/p>\n<p>El incumplimiento de esta obligaci\u00f3n puede conllevar la imposici\u00f3n de <strong>sanciones por parte de la Inspecci\u00f3n de Trabajo<\/strong>, que pueden ir <strong>desde los 626 euros a los 187.515 euros<\/strong>, de acuerdo con lo previsto al respecto en la Ley de Infracciones y Sanciones del Orden Social.<\/p>\n<p>&nbsp;<\/p>\n<p>PROTOCOLO ANTI-ACOSO<\/p>\n<p>El art\u00edculo 48.1 de la Ley Org\u00e1nica 3\/2007, de 22 de marzo, para la igualdad efectiva de mujeres y hombres, establece la <strong>obligaci\u00f3n de todas las empresas de aprobar procedimientos espec\u00edficos para la prevenci\u00f3n del acoso sexual y por raz\u00f3n de sexo.<\/strong><\/p>\n<p>La Ley de Infracciones y Sanciones del Orden Social prev\u00e9 <strong>sanciones que pueden ir<\/strong> <strong>desde los 626 euros a los 187.515 euros, <\/strong>para aquellos casos en los que la empresa no est\u00e9 aplicando ning\u00fan protocolo o no lo est\u00e9 aplicando de forma correcta.<\/p>\n<p>Adicionalmente, la falta de protocolo anti-acoso <strong>puede implicar la responsabilidad de la empresa<\/strong>, tanto <strong>en materia de prevenci\u00f3n de riesgos laborales<\/strong>, como en aquellos litigios que puedan derivarse de una situaci\u00f3n de acoso, ya sea en el <strong>orden social, civil <\/strong>e, incluso,<strong> penal<\/strong>.<\/p>\n<p>&nbsp;<\/p>\n<p>En caso de que no cont\u00e9is con alguno de estos dos instrumentos, <strong><u>nuestro equipo de <a href=\"https:\/\/avantges.com\">laboral<\/a>\u00a0os podr\u00e1 asesorar<\/u><\/strong>.
